A famous criminal defense lawyer warned Friday that actor Alec Baldwin faces more than six years in prison if convicted on all charges.
Baldwin faces two counts of manslaughter in the death of cinematographer Halyna Hutchins, who was murdered on the set of ‘Rust’ in October 2021. Baldwin was also charged with one count of firearms enhancement, which would sentence him to a minimum of five years. in prison if he is convicted.
“If you believe the prosecutors, they think he faces up to six and a half years. The year and a half, plus five years for the gun,” attorney Mark Geragos said on “America’s Newsroom.”
Baldwin has stood by his claims that he did not pull the trigger on the gun, once during a prime-time interview shortly after the deadly shooting and again on a podcast episode.
The actor originally said that he had pulled the firing pin back as far as it would go and released it, but did not pull the trigger.

“It’s going to say, basically, ‘I trust they yelled, it was cold,’ which means there was no bullet in the gun,” Geragos said.
Both the first count of manslaughter, a fourth-degree felony, and the second count of manslaughter in the commission of a lawful act could get the actor sentenced to 18 months in prison.
“The problem [Baldwin] faces in this is manslaughter does not require that you have the intent. You don’t have to be in the state of mind that you wanted to do this. It’s negligence,” Geragos explained.
“And in New Mexico, it’s actually almost common negligence, just to do a legal act illegally. That’s the legal term for it.”
Baldwin, however, was not the only “Rust” member charged Thursday. Hannah Gutierrez-Reed, who was the gunsmith in the movie “Rust,” also was charged with two counts of manslaughter.

After the charges were announced Thursday, Baldwin’s attorney, Luke Nikas, called the charges a “terrible judicial error” in a statement to Fox News Digital.
“This decision misrepresents the tragic death of Halyna Hutchins and represents a terrible miscarriage of justice,” said Luke Nikas of Quinn Emanuel. “Mr. Baldwin had no reason to believe there was a live bullet in the gun, or in any part of the film set. He relied on the professionals he worked with, who assured him that the gun had no live bullets. We will fight against these charges, and we will win.”

Geragos also noted that an “interesting” component of the case is that Baldwin had two roles in the production: actor and producer.
“[The prosecution] they come to him under both theories. They say he’s the actor who pulled the trigger, though he denies doing so, and he’s also the producer who was cutting corners, trying to save money at the expense of safety. So they’ve locked him up, so to speak.”
Geragos said Baldwin’s lawyers will likely seek a plea deal.
“Any good defense attorney, and he has a very good defense attorney, will always explore the idea of a guilty plea. It’s almost bad practice not to. No matter what your client tells you, you should give him his options,” he said. saying.

“If he’s convicted on that charge with mandatory wear, he’s facing five years in prison. So they’re absolutely going to explore some kind of deal,” he told Dana Perino and Bill Hemmer.
